  1. Application

    This Privacy Policy applies to all visitors, users, and others ("consumers" or "you") who interact with Retailer or Service Provider (“we” or “us”); businesses and operations managed or operated by Retailer or Service Provider; and websites owned, operated and managed by Retailer and Service Provider, including each website that links to this Privacy Policy.

    Protecting the privacy and security of your personal information is a priority, and we believe that a single, comprehensive privacy policy that is straightforward and clear is in the best interests of our consumers. We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice.

    The Website collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household or device ("personal information").

    Personal information does not include:

  3. Collection of Personal Information

    We collect personal information in the following circumstances:

    • Directly from you. For example, when you set up an online account on our Website, when you use the “pick up in store” feature on the Website, when you purchase an item on the Website, when you save or post any information on our Website, or respond to a survey that we might ask you to complete for research purposes.
    • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
    • Signing up for promotional communications. For example, if you sign up to receive promotional communications or notifications from us such as newsletters, coupons, and promotion codes, we may ask you to provide personal information so that we can provide these to you.
    • Entering a sweepstakes or contest. For example, if you enter a sweepstakes or contest we offer, we may ask you to provide personal information so that we can consider your entry and, if you win, so that you may redeem your prize.

    California Civil Code 1798.115(c), 1798.130(a)(5)(c), 1798.130(c), and 1798.140 indicate that organizations should disclose whether certain categories of information are “sold” or transferred for an organization’s “business purpose” as those terms are defined under California law. Please note that because this list is comprehensive it may refer to types of information that we share about people other than yourself.     We may use or disclose the personal information we collect for one or more of the following business purposes:

    No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

    We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

  5. Technologies for Automatic Data Collection

    The technologies we use for automatic data collection may include:

    • Browser Local Storage. Certain features of our Website may use local storage objects to collect and store information about your preferences.
    • Browser Cookies. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website.     We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

  9. Access to Specific Information and Data Portability Rights

Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

    • The categories of sources for the personal information we collected about you.

    • The categories of third parties with whom we share that personal information.
    • The specific pieces of personal information we collected about you (also called a data portability request).

  10. Deletion Request Rights

    You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

    We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

    • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
    • Debug products to identify and repair errors that impair existing intended functionality.
    • Exercise free speech; ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
    • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
    • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
    • Comply with a legal obligation.
    • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

  11. Exercising Access, Data Portability, and Deletion Rights

    To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either calling, emailing or mailing us at the Retailer Contact Information above.

    Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

    You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

    • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
    • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

    We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

    Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

    We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

  12. Response Timing and Format

    Upon receiving a “request to know” or a “request to delete,” we will confirm receipt of the request within 10 business days and provide information about how we will process the request.

    We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

    If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

    Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

    We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

  13. Personal Information Sales Opt-Out and Opt-In Rights

    If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 18 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

    To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by submitting a “Do Not Sell My Personal Information” request to the email address in the Retailer Contact Information above. Send a request with your full name, email, phone, mailing address, and subject line “Do Not Sell My Personal Information”.  Please also include the context in which you are requesting this information; for example, reference the website or retail partner that is affiliated with this request.

    Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by contacting us via the Retailer Contact Information above.

    You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

  14. Policies for Minors

    We are committed to complying with all applicable laws and regulations regarding the collection, storage and use of personal information of Minors under the age of 13, including the Children's Online Privacy Protection Act of 1998.

    Please be advised that: (i) our products and services are marketed for and directed towards purchase by adults or with the consent of adults; (ii) individuals under the age of 18 ("Minors") are not permitted to use the Website without the supervision of a parent or legal guardian; (iii) we do not knowingly collect or solicit personal information from children under the age of 18 or knowingly allow such persons to register for an online account or to post personal information on the Website; and (v) should we learn that someone under the age of 18 has provided any personal information to us, we will remove that information as soon as possible.

    If you are a parent or guardian who believes that your Minor under the age of 13 has submitted personal information or other information to us without your consent, please contact us via the Retailer Contact Information above. Once we verify that you are the parent or legal guardian, at your request, we will promptly provide to you information regarding what, if any, personal information we have collected about your child and how it has been used or shared. We will, at your request, remove personal information about your child from its database and instruct our affiliates and third-party partners to do the same.

  15. Non-Discrimination

    We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

    • Deny you goods or services.
    • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
    • Provide you a different level or quality of goods or services.
    • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

    However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

  16. Changes to Our Privacy Notice

    We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the Website and update the notice's effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.

    Any dispute between you and us regarding the privacy of your personal information is subject to this Privacy Policy and our Terms of Use (also accessible via the corresponding link on the bottom of the Website), including limitation on damages, resolution of disputes, and application of the law of the State of California.
